BBC arts editor explains modern art

"What Are You Looking At?: The Surprising, Shocking, and Sometimes Strange Story of 150 Years of Modern Art" (Dutton), by Will Gompertz

If you've ever stood before a painting or sculpture and said "Huh?" or "Excuse me?" or "My kid could do that!" ? then BBC arts editor Will Gompertz has written the perfect book for you.

A former director of London's Tate Gallery, Gompertz has an uncanny knack for making difficult art (and ideas) easy, and doing so without jargon.

In "What Are You Looking At?" he starts from the premise that almost everybody has trouble immediately comprehending work that possesses what the late art critic Robert Hughes memorably called "the shock of the new." Even Sir Nicholas Serota, his old boss at the Tate, admitted to being confounded on occasion, he reports.

"It doesn't matter if you are an established art dealer, a leading academic or a museum curator," he writes. "Anyone can find themselves at something of a loss when facing a painting or sculpture that is fresh out of an artist's studio."

His solution is to place the particular work of art or artist into the long narrative arc of art history ? in other words, through education comes enlightenment. And so he offers a lively, witty account of the major moments and movements of the past 150 years of that history, from Edouard Manet's in-your-face naked harlot "Olympia" to Damien Hirst's pickled shark.

In Gompertz's zeal for the anecdotal, he occasionally resorts to corny re-enactments of famous art history moments ? not surprising for a book that started out as a stand-up comedy show. Some readers may long for a few footnotes and a bibliography, yet it's clear that he really knows his stuff.

In the end, stuffy, pretentious scholarship isn't what he's about. This user-friendly guide is aimed at the millions of participants in today's global modern art market who "suspect, in their heart of hearts, that it's a sham" ? but find that it's not cool to say so.

Conjuring up example after example of artworks that have baffled or enraged the public, Gompertz explains why they aren't a sham. And he's so good at his game that by the end, you may very well be persuaded that "A Thousand Years" ? a Hirst creation that features the rotting head of a dead cow in a glass vitrine ? is ghastly, yes, but also very good art.

Well, let?s celebrate it! (If you can?t beat it?) October is Eczema Awareness Month and recognizes this common inflammatory skin condition that affects approximately 15 million Americans.

That itch, that rash; no matter what you do, it will never permanently go away. Perhaps a skin cr?me here or there can temporarily calm the irritation, but it will never truly disappear. Perhaps it is worse in the colder months or perhaps worse when your respiratory allergies flare. Either way, it is annoying.

Eczema is characterized by a recurrent/chronic red, scaling, oozing and itching skin. Perhaps you have experienced eczema but never thought to review this uncomfortable condition with your doctor. Symptoms are simply irritating (literally).

However, in more severe cases (atopic dermatitis), discomfort can make for a poor quality of life especially if there is an additive bacterial infection complicating the condition. If you're a first-timer, welcome!

You may want to begin this Home Staging series
HERE, from?the 1st day.

When you read or hear the words "bonus room",?

what comes to mind?

Do you think of a loft, sun room, home theater,?

sewing or craft space, guest room, or play room?

Or do you think of a catch-all space, a resting spot for cast-off furniture,?

a place to store the iron and ironing board or Christmas decoration storage?

I've found that "Bonus Room"?is a puzzling term?

describing a room that eludes description.

An extra room is a wonderful selling point in a house,

but the space must be clearly defined as a useable space

or buyers will have a difficult time envisioning themselves using the space.

And they don't want to envision their stuff mingled with yours

if you don't transform that catch-all space.

How do you decide how to use the space?

You will need to know who the typical buyer for your neighborhood is.

Which age group or demographic has been moving to your street

for the past few years?

You can also get this information from your Realtor.

Keep this information in mind when deciding how you want to present this space?

and trying to creatively use the furnishings that you already have.

  • Pack anything extra that isn't going to suggest to the buyer the purpose of the bonus room
  • If the room is rather large, you can suggest another activity in the space (I usually do)
  • If you have a loft, which is on the upper floor and typically an extension of the bedrooms, consider staging it as an extra living area with a loveseat, chair, floor lamp, and end table, or a reading space or office with a chair, desk, and floor lamp; a picture of a dreamy far-off place should be hung nearby
  • For a game or a recreation room, either upstairs or in a basement, a game table (foosball, ping pong, pool), a few chairs, and a table between them are enough; a wall dart board, wall pool cue holder, a few board games on ?the table also suggest fun times together with friends
  • Theater rooms should have a big screen television and some chairs facing the screen or a sectional to suggest a family gathering to catch a show together; some empty ceramic popcorn bowls as props on a table are nice and a few framed classic movie posters (nothing horror-related!) are excellent as art
  • In a children's play area or hangout make a small sitting area (adult- or child-sized); keep only one bookshelf or wall with storage shelves, with toys and games in baskets or neatly stacked (see this post for ideas for a children's/teen's hangout/play space in the basement)
  • For the sun room, a loveseat, a coffee table, and a pair of chairs makes a pleasant spot to relax (a few rocking chairs is lovely, too); suggest reading or birdwatching in this room
  • A craft space is fine in a staged home: simply pack all of the "littles" and keep only the pieces you need (put the rest in baskets or bins and hide most of it); a work table and a few shelves should suffice for staging purposes (too many small things left out translate as clutter in online pictures and in person)
  • A closed-in garage can be staged as practically anything (see above)
  • In an unfinished storage room, pack and remove everything except a few neatly packed storage bins or plastic tubs to give the suggestion that the buyers could also use this space for their seasonal or storage items (don't leave half-finished projects, extra furniture, or things that should have been donated long ago in this space!)
  • A finished basement needs to be transformed into entertaining or guest spaces (if there is a seperate bedroom area or two); you could also make one of the basement guest rooms a workout space (just keep the equipment minimal and provide walking room around the gear)

This upstairs room was a catch-all, a place that couldn't decide what it was.

After moving a few extraneous pieces out,?

creating a focal point with the bookcases?to suggest a theater space,

bringing up the loveseat and tables from the living room,

a rug from the office, a guitar from the attic,

and placing a few games and a wooden train set on the floor,

this room now suggests family quiet time and relaxation.

The loft below was transformed
from a storage room?for leftover childhood mementos

to a relaxing writing area.

An unfinished, off-the-basement storage area

got de-cluttered and simplified to show off?

the floor space?available to prospective buyers.

This room had a personality crisis.

Originally a craft room gone cluttery,

it received a coat of neutral paint and a drawing desk.

On the wall above the desk is an oil drawing?

of the house that belongs to this room.

On the floor, a colorful quilt with throw pillows,?

a book, a cell phone, and some dumbells.

This room, off of a young adult girl's bedroom,?

This sun room was being used for homeschooling.

After purging some unused things and rearranging some furniture,

this is now a cozy space to watch the squirrels play outside.

This play room had been taken over by toys.

They were paired down to the minimum?

and an adult spot?to sit and read was also created.

This room suggest several uses, an important selling feature.

Buyers are excited about having?extra square footage

with which that they can do anything they like.

However, for the purpose of selling,?

YOU have to present the space

as a "bonus" to them,?

as a place with a purpose.

Give buyers ideas for how to use the room:

the promise of being extra usable space,

?no matter what they dream up?for it,?

once they sign the closing papers.

How To Ease Yourself Into An Exercise Program

Many people are aware that exercise has plenty of benefits. In fact, you'd have to pretty much be in a coma your whole life to not know this obvious fact. You can sort of tell by looking at somebody whether or not they're in decent shape or not. Tight muscles, low body fat, upright posture, slim figure. Sure, with so many obese people in the United States, it might not be politically correct to speak in these terms, but if you want to get into shape, you must.

Many people make the mistake of going gung-ho right from the start. They have huge hopes and dreams and a ton of motivation. This is great. But where they stumble is by thinking they can start at a level that is way above their comfort zone. The secret of working out consistently is that it's got to remain inside your comfort zone.

Naturally, in order to accommodate something you're not doing, you've got to expand your comfort zone. But if you try to expand it too quickly, it'll snap right back, and be quite painful to boot. That's why you've got to ease into it.

Think of it this way. Exercise is going to be a lifelong habit. It's not something you'll do for six months, get into shape, and then quit. Because it's something you'll be doing your whole life, doesn't it make sense to ease into it slowly? Of course it does!

So start at a level that is just barely more exercise than you're doing now. If you haven't done anything except walk to your car, walk to work, sit at your desk all day, then walk to your car and drive home, don't think you're going to hit the gym for an hour all of a sudden. Just try to go for a short walk around the block, maybe once or twice a week. Do this for a couple of weeks. Once this seems easy and natural, increase it to every other day.

Once that seems natural, increase it to every day. Once every day seems natural, just increase it however you feel comfortable. For some people, it will be slowly jogging, and eventually running three of four miles a day. For others, it may mean cycling or weight training. Just go wherever you feel most comfortable.

And by all means, give yourself at least six months before you can even think about doing any kind of strenuous exercise on a daily basis. There's no race. You're going to be alive for a long, long time, so you've got plenty of time. Ease into it, and you'll be fine.

An oft-overlooked benefit to Windows 8 licensing: Device variety ...

With a new Windows release, Microsoft is playing up to one it?s key advantages that?s easy to overlook: By licensing its software, buyers can personally choose from a variety of device sizes and form factors. But to play it safe, Surface RT is all Microsoft.

Microsoft?s Windows 8 platform is set to debut this week on Oct. 26 and the company has already introduced its new Surface with Windows RT tablet. With the build-up to the software launch event, Microsoft?s hardware partners are wasting no time in announcing desktops, laptops and more that will run on the new operating system. Last week I suggested that so far, Microsoft hadn?t made a compelling case for people to purchase the Surface device, but new device announcements are reminding me of one key advantage for Windows 8 and Windows RT: Device variety.

Now this isn?t a new concept at all. In fact, it?s one of the key talking points that Microsoft has used for the past two to three decades. By creating a software platform that supports a vast array of hardware components, computer makers can design devices as they see fit. Google actually provides the same strategy with Android, which is why you see smartphones and tablets in varying shapes and sizes running on Android. Contrast that to Apple, which keeps everything in-house: From software to hardware to services, Apple designs products with minimal variance between models. That provides a different advantage in that Apple?s products are highly optimized and work consistently.

Seeing?this new LG Windows 8 device over at Liliputing is what reminded me of this difference. Take a look at the LG H160 tablet: It?s not for everyone, but there?s likely to be a group of consumers or enterprises that crave a tablet type of computer that has a slide-up mechanism hiding a full QWERTY keyboard under the screen.

LG can do that because it controls the hardware design that runs on Microsoft?s software. Going back to the Apple comparison ? you won?t likely every see various iPads with and without keyboards or with a choice of a half-dozen screens sizes. Heck, it?s nearly been 3 years since the first iPad was announced and we?re just now expecting to see a new one with a smaller screen.

Surface RT standIronically, while this is a key advantage for Windows 8, it almost seems that Microsoft is trying to have it both ways with Windows RT. The Surface tablet, which I expect to get some hands on time with later this week, is an all-Microsoft product from beginning to end, the same approach that Apple uses.?That represents an important strategy change for Microsoft as it historically hasn?t designed or made Windows computers. But other hardware partners will also be making and selling Windows RT tablets so in the near future, form factor choices will follow the Surface tablet. So that advantage of ?choose the hardware design you like? will filter down to Windows RT as well.

Regardless of whether you like a company to design both your device hardware and software or not, evidence suggests that consumers desire more choices. There are a number of factors why Windows ? and for that matter, Android in its respective market ? has a majority platform market share. Choice of hardware is surely one of those factors, which of course, is highly related to price?differentiation? And that?s something I neglected when thinking about Microsoft making its case to generate interest in Windows RT and the Surface tablet. The company still has to deliver useful software and services, for sure. Choice of hardware, however, can help make up for deficiencies in other areas.

ScienceDaily (Oct. 22, 2012) ? Scientists have determined the three-dimensional structure of a complete, unmodified G-protein-coupled receptor in its native environment: embedded in a membrane in physiological conditions.

Using NMR spectroscopy, the team mapped the arrangement of atoms in a protein called CXCR1, which detects the inflammatory signal interleukin 8 and, through a G protein located inside the cell, triggers a cascade of events that can mobilize immune cells, for example.

Because G protein-coupled receptors are critical for many cellular responses to external signals, they have been a major target for drugs. More precise knowledge of the shapes of these receptors will allow drugmakers to tailor small molecules to better fit specific targets, avoiding collateral hits that can cause detrimental side effects.

"This finding will have a major impact on structure-based drug development since for the first time the principal class of drug receptors can be studied in their biologically active forms where they interact with other proteins and potential drugs," said Stanley Opella, professor of chemistry and biochemistry at the University of California, San Diego who led the work, which Nature published online October 21st in advance of the print edition.

Protein structures are most often determined by reading the diffraction patterns of X-rays beamed at their crystalline form, but crystallizing such large, unwieldy molecules is a challenge often met with strategies such as snipping off floppy ends.

Those changes can alter the shape of critical regions of the protein. "Our approach was to not touch the protein," Opella said. "We are working with molecules in their active form."

Their strategy has revealed a new view of these receptors. Previous reports have all noted seven helices weaving through the membrane. Opella's group sees an eighth lying on the membrane surface, a trait that at least some other G protein-coupled receptors must share.

And the loops inside and outside of the cell are structured. "For years people thought the loops were mobile. They're not," Opella said. "The signals we get from the loops aren't any weaker than the other parts of the protein as they would be if they were waving about."

CXCR1 has been implicated in the progression of several types of cancer. In one example, preclinical studies have shown that blocking this receptor inhibits the undifferentiated stem cells within breast cancer tumors, leading to the death of all tumor cell types and stopping them from seeding new tumors.

Opella and colleagues hope this finding along with continuing studies of changes in this receptor's configuration as it binds to interleukin 8 and drug candidate will lead to more effective and less harmful cancer treatments.

Luxembourg royals wed in religious ceremony, wrapping up 2-day nuptials

LUXEMBOURG - Luxembourg Prince Guillaume and Belgian Countess Stephanie de Lannoy have put the finishing touches on their two-day wedding extravaganza with a religious ceremony at the tiny duchy's Notre Dame Cathedral.

With a celebratory fireworks show still to come, Saturday's church wedding drew onlookers lining the streets and royals from around the globe including Crown Prince Naruhito of Japan, royal couples from Sweden and Denmark, and Britain's Prince Edward ? Queen Elizabeth's youngest child ? and his wife, Sophie.

The couple also had a civil ceremony Friday at city hall.

Stephanie plans to renounce her Belgian citizenship in order to one day become Luxembourg's grand duchess. The tiny country wedged between France, Belgium and Germany is an important financial centre and continues to prosper despite Europe's economic trouble.

The news that real estate broker Ed Ahmad had plead ?guilty? to ? bank and wire fraud that included conspiracy? to defraud various lending institutions by doing false appraisals of the values of properties, created quite a stir in his native Guyana and in the large expatriate community centred in Richmond Hill, Queens, New York. But behind the sad denouement in this Horatio Alger Guyanese-American success story, lies a larger tale of a dysfunctional financial system that facilitated the fall, but one which the authorities refuse to fix.
Ed Ahmad?s rise and fall is a product of the U.S. subprime crisis that was created way back in the 1980s. The ?securitization? of mortgages by private institutions turned the staid mortgage business into a go-go casino. The traditional mortgage model involved a bank originating a loan to the borrower/homeowner and retaining the credit (default) risk. Securitization is a process whereby loans or other income generating assets are bundled to create bonds which can be sold to investors.
Started by some U.S. government mortgage institutions, it also became a process through which the biggest private financial institutions realised they could spin straw into gold. Unlike the government, they pooled non-conforming mortgages and generally did not guarantee the bonds against default of the underlying mortgages. That is, they had no responsibility since they transferred both interest rate risk and default risk to the purchaser with their mortgage-backed securities and collateralized debt obligations (CDO). ?Through a formula there was theoretically always a fraction that would ?perform? ? and these could now be sold as AAA.
Not surprisingly, the practice encouraged what is understatedly called ?moral hazard? since the processing of mortgage transactions was incentivized but ensuring their credit quality was not. High-risk mortgages were now demanded. In other words, brokers like Ed Ahmad were encouraged ? even pressured ? to push through mortgages without credit checks. The government itself did its part by pushing the notion that home ownership by the poorest Americans ought to be facilitated.
?Subprime mortgages?, made out to borrowers with lower credit ratings skyrocketed. As a result of the borrower?s lowered credit rating, lending institutions charge higher interest than in conventional mortgages in order to compensate themselves for carrying more risk. One typical variety, sold by people like Ahmad, was the 2/28 Adjustable Rate Mortgage (ARM) loan, known as a ?hybrid? mortgage. The ?2? stands for the first two years of the mortgage loan, which have a fixed rate. The ?28? represents the next 28 years of the loan which have an adjustable rate and are subject to interest rate adjustments approximately every six months.
Most often, people obtaining a 2/28 loan consider it a temporary situation and intend to refinance within those first two years because of the potential of high interest adjustments making their payments skyrocket. 2/28 ARMs have a ceiling rate like any adjustable rate mortgage, but this rate can be upwards of 13 per cent. Clients take the risk, because in a booming real estate market they can always refinance with second mortgages. Ahmad?s clients claim that they were not aware of the implications, but in the real estate market it was always ?caveat emptor?.
By March 2007, with the value of American subprime mortgages estimated at US$1.3 trillion, the United States housing bubble burst and the demands of the NINJA home mortgages (no income, no jobs or assets) came home to roost. Millions of borrowers who had boasted about their ?assets? locked up in their homes could not make their payments. For them the foreclosures that threw them into the streets was a tragedy.
But for the banks and other financial institutions that sold billions of dollars of securities backed by the mortgages it was just a blip in their spinning of gold from straw. They were ?too big to fail?, received bailouts from the government, and are now busy throwing people into the streets. They were not jailed.

iPad mini? Five reasons why it's a risky business for Apple ...

We?re just a few short weeks out from an eagerly awaited Apple product launch and some of us are already getting excited about another.

Apple has called another media event for 23 October. If you don?t know what it?s likely to be about, you?ve probably been abstaining from the internet for the past three months.

The iPhone 5 is still difficult to get hold of in some areas after a record-breaking launch weekend. But - if that is even possible - the announcement predicted by pretty much everyone in the technology industry of a smaller iPad is even more keenly anticipated.

Again, the doubling-down on secrets that Tim Cook promised has failed to materialise. Like the iPhone 5 before it, the iPad mini has been the worst-kept secret in tech for many months and viewed as common knowledge for the past few.

The Wall Street Journal was the first to report on the smaller tablet device back in February. Since then, every tech site and blogger has talked in increasingly assured terms about the new device.

Most are calling it the iPad mini, or possibly the iPad nano. It?s also conceivable there is no product, as some have argued - but let?s face it, they?re fooling no one. For the sake of clarity, we?ll refer to the phantom device as the iPad mini.

Apple?s manufacturers in overdrive

Multiple reports claim Apple?s manufacturers have gone into overdrive creating the devices ahead of the 23 October unveiling. The Wall Street Journal goes as far as to claim Apple has ordered 10 million units from suppliers as we head into the hugely lucrative holiday season. A new iPhone and a new iPad? It?s going to be some holiday season in Cupertino.

However, the new product represents more of a challenge for Apple than meets the eye.

When the iPad arrived, the market consisted of it and some tumbleweed. Two iterations later and the market is still dominated by the iPad. There are also a host of other devices from other manufacturers, which are struggling to make inroads into Apple?s lead.

The iPad mini faces a different challenge from its larger cousin, which lest we forget is not even three years old.

If it comes to pass, the iPad mini will represent Apple?s most challenging and potentially risky product launch for some time.

Risk 1. Stiffer competition

First, the smaller screen tablet market is very different from the field the iPad entered in 2010. There are a number of interesting devices from leading manufacturers that are already laying claim to the space.

Samsung was the first major competitor to arrive with the seven-inch Galaxy Tab. Now there are a number of heavyweight competitors in the market - most notably Amazon and Google - both of whom have won plaudits for their devices. So unlike the larger iPad, Apple will face stiffer competition from the outset.

Risk 2. Price and Apple margins

Second is the matter of price. Apple enjoys high profit margins on all its products but price will be a key consideration for consumers.

The iPad 2 currently costs $399, or ?329 in the UK. The new iPod Touch starts at $299 and ?249, while the 8GB Nexus 7 is sold for $230 and ?159 and the $174 ad-free Kindle Fire will shortly be available in the UK for ?169.

Amazon admitted to the BBC recently that it made no money from Kindle hardware, instead driving revenue from its content ecosystem. Apple will want the best of both worlds and enter a market just for the sake of being in there, especially one that so far has not been commercially a runaway success compared with the iPad?s.

My feeling is that Apple won?t try and compete on price but will retain its margins and hope its brand and residual halo effect convince enough consumers to pay that little bit extra.

Risk 3. Cannibalising the iPad

There?s the risk that Apple may end up cannibalising sales of other iOS devices with the iPad mini. But the Apple philosophy is that it?s better to cannibalise your own product with another of your own. Jobs told his biographer: ?If you don?t cannibalise yourself, someone else will.?

Risk 4. Inferior screen resolution

Fourth, we come to the screen. One school of thought believes the iPad mini will launch without a so-called Retina display, an Apple marketing term to designate the high-resolution screen that first appeared on the iPhone 4 and has since spread to other devices including the iPad, iPod Touch and 15-inch MacBook Pro.

A smaller 13-inch MacBook Pro with Retina Display is also widely expected for the 23 October event but a common theory is that the 7.85-inch iPad mini will have a resolution of 1,024?768 - half that of the current iPad. The thinking is that this will allow developers to scale existing apps for the smaller device.

Apple has made the Retina Display a key marketing tool for its products. There?s no doubt that a smaller resolution display on a device with a screen size between others with a Retina Display will be perceived as step back for the company.

Risk 5. Damaging Apple?s user experience

Finally, there?s the user experience. Steve Jobs was less than complimentary about the seven-inch form factor, describing devices as being dead on arrival and complaining that users needed to sandpaper their fingers to scale down to the smaller form.

This pronouncement may have been Jobs being Jobs - after all, he flatly denied Apple was working on a tablet a number of times. However, combine the smaller screen real estate along with the possible lack of a Retina display and you have a number of criteria eating away at the overall quality of the user experience. Just scaling down apps for smaller screens may not be enough. iPhone apps mostly scale terribly to the iPad. Developers may have more work to do for the smaller iPad.

Despite the risks, it?s difficult to bet against Apple at the moment and 10 million sales of iPads heading into the holiday season doesn?t seem that outlandish.

However, we?re in for an interesting quarter if and when the device is unveiled on 23 October. The tech community loves to criticise the top player and how Apple deals with each of the five risks above will be key.

Will the competition prove more challenging than in the existing market? Will it be too expensive compared with competitors? Will the smaller iPad gnaw away at sales of its big brother or the iPod touch? Will an inferior screen resolution put users off? Will it fall short of the standards Apple sets for its products? user experience?

The iPad mini may well prove to be the trickiest balancing act of features and marketing that Apple has attempted in some time.

William Hunter, longtime adviser to two New Orleans sheriffs, dead ...

William Hunter, who served a short stint as Orleans Parish Criminal Sheriff in 2004, died Monday of heart failure at Interim LSU Public Hospital. He was 69.

Hunter ran the sheriff's office for 10 months after his longtime boss, Charles Foti, was elected Louisiana's attorney general. He initially declared he had no interest in running for a full term, but unsuccessfully stood for election later that year. Mr. Hunter went on to work for Marlin Gusman, the victor, as a chief deputy.

Mr. Hunter was a top adviser to Foti for a quarter-century. He earned bachelor's and master's degrees at Tulane University.

After serving as a Marine in Vietnam, Mr. Hunter was a member of the Mayor's Criminal Justice Coordinating Council before joining Foti's office in the late 1970s.

He was director of the office's Intake and Processing Center and the Records and Property Division. He also oversaw several programs within the office, such as a pretrial release program and the National Institute of Justice's Arrestee Drug Abuse Monitoring program.

After Foti was elected state attorney general in 2003, he named Mr. Hunter chief deputy in January 2004, clearing the way for him to be his interim successor when Foti took the oath of office two days later.

At that time, Mr. Hunter's response was terse -- "Absolutely not" -- when asked whether he was interested in running for the job that fall.

"I have no interest in political office," he said.

Six months later, Mr. Hunter changed his mind, saying the city's criminal-justice system was in "desperate need" of an experience corrections professional such as himself.

He placed third in a nine-person field.

Survivors include his wife, Charlotte Hunter, and a stepson, Sebastian Peters.

A funeral will be held Saturday at 1:30 p.m. the chapel of Tharp-Sontheimer-Tharp Funeral Home, 1600 N. Causeway Blvd., in Metairie. Visitation will start at 9 a.m.

Burial will be in the Garden of Memories.

The U.S. commercial real estate marketplace will continue to recover in 2013 with modest gains in leasing, rents and pricing, according to PwC US and Urban Land Institute's Emerging Trends in Real Estate Forecast for 2013, presented on October 17th in a webcast delivered from the ULI's annual conference held in Denver. The opinions expressed in the report were derived from over 900 interviews and surveys of commercial real estate leaders.?

According to survey participants, although the real estate recovery is slower than normal, the prospects for all property sectors are better than in 2012. "Recent job creation should be enough to increase absorption and push down vacancy rates in the office, industrial and retail sectors, helped by the limited new supply in commercial markets," according to the report.? Strong demand for apartments is expected to continue in 2013, even as new projects come online. And even the single family home sector is doing better in most regions. The only problems in the housing arena are in the leisure and second home markets.

"With the outlook for commercial real estate continuing to improve in 2013, investors are expected to allocate substantial sums of capital to the real estate asset class, according to our survey respondents," says Mitchel Roschelle, partner, U.S. real estate advisory practice leader at PwC. "As yields on bonds and other financial instruments tighten in a still volatile market, commercial real estate's income producing and total return attributes offer investors potentially attractive risk-adjusted returns," he said.

Even as riskier secondary markets become more attractive to real estate investors, "many believe the move cannot be made without concentration on leasing to high-quality tenants within growth industries that are sustainable," according to the report. But as property prices rise and even exceed pre-recession levels in San Francisco, New York City, Boston, Washington, D.C., Los Angeles and Chicago, the focus is on the lessee's value, market demographics and job growth, among other factors.

According to survey respondents, investors should use caution in investing in secondary markets and? focus on income-generating properties at the same time partnering with a local operator who understands the market. "Markets grounded in energy and high-tech industries show the most near-term promise, while places anchored by major education and medical institutions should perform better over time," says the report.

The top 10 markets to invest in are San Francisco, New York City, San Jose, Boston, Houston, Seattle, Austin, Denver, Orange County, California and Dallas Ft. Worth. A snapshot of the top five markets in the report lists each one's special attributes, summarized below:

  • San Francisco is driven by growth and a strong jobs outlook led by technology. The downtown is stealing the spotlight from suburbia. Continued infill development is supported by one of the best transit systems in the country and its high level of walkabilty is second only to New York City.
  • New York City has the second best investment prospects, although there is concern about a run-up in commercial real estate prices. Twenty percent of jobs are in the growing healthcare and education sectors and the market has an important "echo boomer" population.
  • San Jose is dominated by high technology jobs. Although there is a lack of job diversity, the 6,600 technology companies employ 225,000 people.
  • Austin looks likely to expand its commercial real estate market, given its forecast of a 2.3% increase in population in 2013, which is driven by Echo Boomers.
  • Houston is dominated by energy-related employment. Survey participants believe the main buying opportunities are in the industrial sector.?????

(AP) ? Five people were found dead in a neighborhood bar where a fire broke out around closing time early Wednesday, and police think the blaze was set to cover up their slayings.

The fire at Fero's Bar & Grill was reported around closing time at 2 a.m., Police Chief Robert White said.

Firefighters found four women and one man dead inside the bar. Police don't think the fire killed them.

"There is just trauma, enough information to believe that we have a homicide that occurred here. They didn't perish in the fire," police Commander Ronald Saunier said.

The fire didn't appear to be very large. No damage to the bar was visible from the street or aerial news coverage. Red stains that appeared to be blood were visible on the sidewalk in front of the bar. Some of the stains were in trails on the sidewalk and others appeared to have been where blood had pooled.

The bar is located in a strip mall about five miles south of downtown Denver just beyond the tony Cherry Creek North shopping district. The bar attracted both regulars and people staying in nearby hotels but neighbors said it didn't seem busy most days. It's wedged in among a check cashing store, a tennis shop, a nail salon and a car repair shop in the strip mall on one of the city's busiest streets, Colorado Boulevard.

Frequent patron Chris Brady said the customers ranged from "semi-homeless-looking people" to patrons in suits and ties.

He was at the bar for a regular poker game held Tuesdays and won $25 cash before leaving about 11 p.m.

"There was nobody random or crazy in there," Brady said.

Brady said bar co-owner Young Fero, who cooks up beef bowls at a moment's notice, usually would close the bar herself, and she bid him goodnight Tuesday as he paid his tab.

"She said, "Thank you sweetie, have a good night,'" Brady said. "I said, 'You too.'"

No one answered the door at Young Fero's home in Aurora. A sign on the door read, "Day sleeper, please don't ring the doorbell! Thank you." It was signed "The sleeper."

Neighbor Mike Spinale described Fero as "really nice."

"She didn't speak much, but I know she owned a bar and she worked all the time," Spinale said. "She told me she did everything herself."

Danny Fero, who described himself as Young Fero's ex-husband, said he went to the scene Wednesday and talked with police, but he wasn't asked to identify any of the bodies. He said he did not know who might have been at the bar Wednesday morning.

"She always worked late and closed the bar," he said.

He doesn't know if she was one of the victims.

Danny Fero said he talked with her about a month ago regarding a visit with their daughter, but his ex-wife made no mention of any threats. He said he was shocked by the events at the bar he once co-owned with her.

"I wanted to make myself available to police as soon as possible," Danny Fero said, adding police asked him not to discuss other details of the case.

Business seemed to go on as usual in the surrounding area as police investigated the slayings. People walked their dogs and customers visited a nearby vitamin shop.

The five dead are believed to be the only ones in the bar when the fire started ? other than whoever is responsible for their deaths ?so police are asking anyone else who was at the place earlier to come forward, as investigators try to piece together what happened.

The victims haven't been identified. Autopsies were expected to be completed later in the day.

Frank Peluso, who works in an office building a half block away, said he used to eat lunch at the bar but hasn't been there in three years. He said it seemed to be declining and the owners have tried various things to attract more business, including offering karaoke.

"It's one of those places that you wonder how it stays in business," Peluso said.

Resident Matthew Neam said you can't see into the bar because the front windows are frosted. He said he and his friend used to joke about what might be inside.

"I've never gone in there. It always looked kind of sketchy to me," Neam said.

European shares edge up as China data eases growth worries

LONDON (Reuters) - European shares edged toward a one-month high and Asian stocks surged on Thursday, as a slew of Chinese data boosted optimism over the health of the world economy.

The gains were being held in check by concerns there could be disagreements at a two-day European leaders' meeting, which begins later, over plans for a banking union or measures to help struggling Spain and Greece.

No substantial decisions are expected to be taken at the summit and that could revive concerns about complacency in tackling the three-year-old debt crisis.

The FTSE Eurofirst 300 <.fteu3> index of top European shares, which hit a three-week high on Wednesday, steadied at around 1119.15 points, a gain of just 0.045 percent.

London's FTSE 100 <.ftse>, Paris's CAC-40 <.fchi> and Frankfurt's DAX <.gdaxi> opened between unchanged and 0.1 percent higher. U.S. stock futures were slightly lower. <.l><.eu><.n/>

"We could edge higher if Spain asks for assistance from the European Central Bank, but any gains will likely be short-lived as investors focus on company earnings," said Heinz-Gerd Sonnenschein, equity markets strategist at Deutsche Postbank.

China's third-quarter gross domestic product grew 7.4 percent from a year earlier, the slowest pace since the first quarter of 2009 but in line with expectations, while other data such as a 9.2 percent rise in industrial output for September exceeded forecasts.

"The economy is showing signs of stabilising. That is good news," said Dong Tai, economist at Credit Suisse in Hong Kong.

The commodities-sensitive Australian dollar touched a two-week high of $1.0397 after the Chinese data, and last traded at $1.0376.

Even the dollar rose, touching a one-month high of 79.22 yen, after data on Wednesday showed the U.S. housing market improving sharply in September leaving the Japanese currency to take the brunt of investor selling.

Poland summons Russian ambassador over plane crash victims' photos

WARSAW (Reuters) - Poland's Foreign Ministry summoned the Russian ambassador to Warsaw on Wednesday to protest against the release of photographs showing mangled bodies from a 2010 plane crash that killed the Polish president and 95 others.

Several Russian websites published photographs depicting what appeared to be the body of President Lech Kaczynski and partial remains of others who died when a government plane crashed in heavy fog in western Russia.

"Deputy Minister (Jerzy) Pomianowski told the Russian ambassador that Poland expects the Russian authorities to take firm measures, promptly launch an inquiry into the matter, and punish those responsible for the leaked images," the foreign ministry said in a statement released after the meeting with envoy Alexander Alexeev.

The appearance of the photographs is another embarrassment for Russian and Polish authorities after prosecutors in Warsaw last month said at least two families received and buried the wrong bodies.

That revelation has raised questions about how many other bodies were wrongly identified after the crash - an event which traumatized the nation and still complicates relations with Poland's neighbor Russia.

The foreign ministry said it acknowledged that Russia, which oversaw the investigation of the catastrophe and the identification of the victims, took steps to block some Russian websites that posted the photographs.

Reuters was able to access one of the websites with links to seven photographs, showing the site of the crash with scattered bodies, remains on a plastic canvas and the body of what appeared to be President Kaczynski on a metal gurney and a black coffin.

Russia's federal Investigative Committee, which answers only to President Vladimir Putin, said in a statement on Wednesday it was looking into the case and seeking to establish who was behind the publication. It added it was also aiming to withdraw the pictures from media.

Russian investigators have blamed the crew of the Polish government Tu-154 for the crash, while a Polish report pointed the finger at Russian ground controllers for allowing the jet to land in heavy fog at a small airport near Smolensk.

Kyrgyzstan: Maxim Bakiyev Faces Prolonged Legal Battle in West ...

Legal pressure is building on Maxim Bakiyev, the son of Kyrgyzstan's former president.

Shortly after Bakiyev was detained in Great Britain on October 12, the American Embassy in the Kyrgyz capital Bishkek issued a statement saying the US government is seeking his extradition to "face trial in US federal court on serious charges of conspiracy to commit securities fraud and obstruction of justice."

An affidavit, filed in April in US District Court for the Eastern District of New York, and obtained by EurasiaNet.org, identifies "a high level government official" from a "Central Asian country" as "co-conspirator #1" in an insider trading case involving US securities. The affidavit does not name the particular Central Asian state in question, but it does assert that the government of said state was "overthrown in a coup in April 2010." As a result, co-conspirator #1 "fled to England."

Former Kyrgyz president Kurmanbek Bakiyev's administration collapsed in April 2010 amid mass protests. Almost 100 people were killed in Bishkek on April 7, 2010, when security forces loyal to the elder Bakiyev opened fire on protesters. The former president and his brother, Janysh, are being tried in absentia for the deaths. Maxim Bakiyev, meanwhile, has reportedly spent the past two years in the United Kingdom. He faces money laundering and corruption charges back home in Kyrgyzstan.

The claims contained in the affidavit are attributed to an individual identified only as a "confidential source," or CS, who "agreed to cooperate with the United States government" starting in December 2011. Approximately six months earlier, a US federal magistrate had issued an arrest warrant for the CS "based on complaint charging the CS with an extortion conspiracy conducted in the Central Asian country," the affidavit states.

The court document describes the CS as a former "chief executive officer of a financial advisory and consulting firm based in New York, New York, and in a country located in Central Asia." The CS' clients "included various government entities of the Central Asian country." The CS also "had a personal and professional relationship with a high-level government official," according to the court document.

The CS told FBI officials that "since approximately April 2010, the CS has managed CC-1's [co-conspirator #1] investments," including "online securities trading activity" that was based on "inside information" acquired from other individuals. The affidavit, taken from an FBI special agent, was submitted in order to establish probable cause for an arrest warrant for one of the individuals who allegedly provided insider information. It spotlights three allegedly illegal trades involving "American public companies, whose securities are traded on national stock exchanges (including the New York Stock Exchange [NYSE] and the NASDAQ Stock Market Inc. [NASDAQ]."

One stock purchase on or about September 8-9, 2011, and the subsequent sale of the same shares on September 12, 2011, attracted the attention of the Securities and Exchange Commission, which in mid-September filed a complaint that characterized "these transactions as 'highly profitable and suspicious.'" The profits from the transactions, approximately $1.7 million, were frozen, the affidavit states.

The CS, according to the affidavit, has "admitted his/her activities in connection with insider trading and other criminal activity." It also states the information provided by the CS "has been corroborated by, among other things, bank records, consensual recordings, information provided by other witnesses and public records." The CS also is confronting money-laundering charges in Italy "arising from a large and complex tax fraud scheme," the affidavit adds.

The younger Bakiyev was taken into custody by London municipal police following an extradition request issued by the United States. Bakiyev appeared in Westminster Magistrates Court on October 12 to face criminal charges, including conspiracy to obstruct justice in the United States, according to a report distributed by the British Broadcasting Corp. Bakiyev was released on bail pending a December 7 hearing.

Politicians in Bishkek hailed the news of Bakiyev's arrest. "It gives the feeling that justice prevails, and that government is in fact doing something, taking measures for criminals to be punished sooner or later. Everyone should realize that all people are equal before the law," said Kurmanbek Dyikanbaev, an MP with the opposition Respublika party.

"It will increase popular support for [Kyrgyz President Almazbek] Atambayev," Dyikanbaev added. "It will definitely increase the level of trust in the authorities among the people."

Washington, not Bishkek, appears to have been the driving force behind the younger Bakiyev?s October 12 detention. American officials confirm that criminal prosecutions are initiated by the Department of Justice and not the Department of State. ?This is about a specific violation within our jurisdiction,? said one American official. ?It?s a straight-forward law-enforcement issue.?

Kyrgyz officials would like to put Maxim Bakiyev on trial in Bishkek. But there is no extradition treaty between the United States and Kyrgyzstan, and, even if there were a pact in place, Western officials have privately long expressed reservations about whether Bakiyev could receive a fair trial in Kyrgyzstan.
